When the Prosecution Backs Down: Why So Many of Our Clients Walk Free

It’s a part of our day-to-day reality that many of the cases we prepare for with precision and commitment never actually reach a verdict not because our clients plead guilty or accept a lesser outcome, but because the Crown Prosecution Service (CPS) offers no evidence.

It’s a phrase that brings both relief and frustration; relief for the client, whose ordeal finally ends, but frustration for the months (or even years) they’ve endured under the weight of a prosecution that should never have been brought in the first place.

Yesterday, we saw a dramatic example of this unfold in court.

Case Study: A Courtroom Drama With a Just Ending

In a long-running case involving a failure to provide allegation, our client stood accused of refusing to give a breath specimen following arrest. The prosecution had refused all along to back down, despite multiple representations and clear concerns about the way the arrest had been handled.

At trial, the case unfolded with all the tension of a courtroom drama. The arresting officer was cross-examined extensively about the force used during the arrest. In a moment of stunning candour and possibly hubris, he admitted he had inflicted pain on our client deliberately in order to “make him listen.”

That admission was the gift we couldn’t have written into the script ourselves.

While police officers are legally entitled to use reasonable force during an arrest, that force must be proportionate and necessary in the circumstances. Inflicting pain simply to gain compliance is not reasonable, and such conduct risks turning lawful restraint into unlawful assault.

As soon as the officer stepped down from the witness box, the CPS announced they would offer no evidence. The case collapsed. Another innocent client walked free but only after months of unnecessary turmoil.

Why the CPS So Often Offers No Evidence

This latest case is just one of many where our preparation, persistence, and cross-examination expose fatal flaws in the prosecution’s case, leading the CPS to abandon it, often dramatically, mid-trial.

There are several common reasons why the CPS may offer no evidence:

1. Insufficient Evidence
   • The CPS concludes the evidence falls short of proving the case beyond reasonable doubt.

2. Unreliable or Absent Witnesses
   • Witnesses may fail to attend, change their story, or be deemed unreliable upon review.

3. New Defence Evidence
   • Our own investigations often unearth compelling evidence that undermines the prosecution.

4. Procedural or Evidential Errors
   • Failures in disclosure, custody procedure, or breaches of PACE often render key evidence inadmissible.

5. Public Interest Factors
   • Continuing the case may not be deemed proportionate or necessary based on the defendant’s circumstances.

6. Abuse of Process
   • Where there’s evidence of fundamental unfairness, we challenge the legality of the prosecution itself.

7. Health Considerations
   • If the defendant or key witnesses are unfit, the case may not proceed.

8. Administrative Failings
   • Disclosure errors, missing evidence, or unprepared cases can result in abandonment.
