There are dozens of drink driving defences that the majority of solicitors are blissfully unaware of. We don’t intend to publish details of them all as even though the law is open to all to interpret, the defences we employ in our clients’ cases are, to some extent, trade secrets.
What we will do is outline what is NOT a valid defence to drink driving and some of the more commonly known acceptable defences. No Drink Driving Defence
- I had not eaten all day
- My drinks were spiked (this one is not a defence but could be a special reason)
- I was taking medication
- My name is spelled incorrectly on the charge sheet
- The time of the breath test is an hour out
- I was only moving my car (again, this could be a special reason)
- The police did not breathalyse me before releasing me to check I was back under the limit
- The police put handcuffs on me when they arrested me
- I was not allowed to speak to a solicitor (although see below)
- I was not allowed to give a blood or urine test instead of a breath test (this is only allowed/required in a handful of scenarios and is not an absolute right)
Valid Drink Driving Defences
- I drank alcohol after driving (hip-flask defence)
- I drove as I was in fear of my life or the life of another (duress)
- I drove on private land only (the law on this point specifies that the land must be more than private property but must restrict access to members of the public by way of signs, a barrier or membership)
- I was not driving/had no intention to drive
- I was denied access to a solicitor – this is a defence in certain circumstances. The police do not have to ensure you have the opportunity to speak with a solicitor if it will delay the drink drive procedure. If no delay is likely, then you should still be afforded this right and denial of it can amount to a defence. The full circumstances of the case will be relevant for this defence to succeed
- The breath, blood or urine test was wrong
- My blood or urine has been tested under the limit but the police sample is over the limit
- I was not offered the breath printout/blood/urine
- Police Procedure – this is a minefield! Chances are police procedure can be challenged in your case even if it seems as though everything was conducted professionally. We know what issues are likely to arise to invalidate the procedure and therefore the case against you and so we strongly urge you to contact us to discuss this in more detail if you are keen on exploring the possibility of defending your drink driving charge.
- CPS Procedure – the Crown Prosecution Service are obliged to comply with a number of duties of disclosure throughout the case. If there is a breach of procedure on the part of the CPS, we frequently use this to our client’s advantage as one of our many defence strategies.
