View Sentencing Council Guidelines Drink Driving Penalty
A conviction for drink driving carries with it a mandatory penalty of a minimum 12 month disqualification. Being banned from the road brings a whole host of logistical nightmares for anyone reliant on your vehicle to get around. Sometimes public transport just isn’t practical and taxi fares soon become very expensive.
There is nothing you can say or do to get the court to be more lenient and allow you to continue to drive if pleading guilty to a drink drive charge (unless certain very specific special reasons are accepted.)
That said, the Magistrates may offer you the opportunity to participate in a Drink Drive Rehabilitation Course (DDRC) with a time limit on when the course must be satisfactorily completed. The course is only offered to those convicted of driving or being in charge of a motor vehicle with excess alcohol in your breath, blood or urine and failing to provide a specimen. It does not extend to drug driving offences.
If you choose to participate in a drink driving rehabilitation course and complete it within a specified timeframe, the length of your ban will be reduced, often by 25%. If you are offered a place on the course this will be done at the time of sentencing, and you must decide then and there. You will not be allowed to change your mind at a later date so you it is wise to consider this option before your court date.
Courses should cost you no more than £250 and are offered at locations across the country. When you commence your sessions you will be introduced to qualified road safety trainers who will teach you all about the effect alcohol has on road users and how you can take steps to prevent further offences in the future. Lessons usually take the form of group exercises, class discussions, workbooks and presentations. The course is not formally assessed and there is no test, however you must participate in each and every session and attend in a state of sobriety. The course provider will notify the court of the outcome of the course and it is only then that the reduction in the drink driving disqualification will apply.
In addition to the reduction in your sentence, you shall benefit from an increased knowledge of road safety and an improvement in your insurance premiums. On completion of all of the sessions you shall receive an official certificate as proof of your participation and advice on how and when to reapply for your licence.

I was stopped with allegedly twice the legal limit of alcohol in my breath in West Wales. At first I thought my case was hopeless but I also thought the police had not followed due process on a couple of facets. So I started the process of researching into who might be able to help me. In short I spoke to all of the main firms and Geoffrey Miller stood out firstly being by far the best and secondly on the surface expensive.
Jeanette Miller picked up my initial call – she gave me alot of her time and was reassuring. More importantly she is a data driven business woman – the data proves that her company is the best in class – others can’t provide the same level of verified performance in my experience.
My case was handled by Louis Young – he was always available to speak, super organised and exactly the person you want on your side to deal with a complex process. I was represented in court by Richard Seynor – a brilliant barrister who was able to think on his feet and responded to a complex situation and a disorganised CPS.
My case was dismissed after three stressful hearings and my license is clean; a perfect result.
In terms of the costs yes this is an expensive process but the truth is you pay what you get for. Others split the cost so in fact you don’t understand your exposure initially. I sincerely believe the effort Geoffrey Miller justifies the fees (I am a consultant and understand how expensive it is to do a good job) – they do the hard work necessary to win thus their 5 star ratings are a refllection of their professionalism. If you want to contest a case put your trust in them – it will not be any easy process trust me but the alterantive is far worse. With Geofrrey Miller you have given yourself the best chance and if you are going to spend money then it is money spent wisely. The journey is hard but try and relax and let them do their job – they know it back to front and actually everyone I spoke to within the company was also jolly nice. Finally get a breathalyer and use it before you drive – I have and have learnt alot about especially what my personal limit is especially the morning after. This is not a situation I would want to find myself in again
Elnaz originally dealt with my case and was great, she explained everything to me really well and helped me understand what to expect at the magistrates court. My advocate on the day of the magistrates hearing was also really great he was friendly and professional and put me at ease. Austin took over my case giving me regular updates and information. He was amazing and thanks to his hard work my case got dismissed before trial due to lack of evidence. I cannot thank the team enough, they really are the best at what they do.
I was faced with the dreadful experience of having to go to court for a motoring offence. I didn’t know what to do and was not in a good way for the first 24 hours or so. Then I happened to make a call to Geoffrey Solicitors. Not having heard of them before, I had never needed to, I didn’t know what to expect. Jeanette Miller called me back after I sat and waited nervous for a couple of minutes at my kitchen table. And I must confess: after talking to Jeanette a whole new world opened to me. And it went on to more positives from there. Elizabeth Morris, who got my case, held my hand, not literary, but in every other sense. I was being looked after in the best way I can imagine. It was a few difficult moments which I had to work out for myself. But I could only do that with the knowledge of having Elizabeth and Jeanette behind me. I must admit I had a few sleepless nights. When my case finally went to court, thanks to my fantastic team with my brilliant barrister Phillip Lucas, the prosecution’s case just fell apart. Acquitted it’s called, a fantastic word. I could hardly believe it. This is what hard brilliant work and a fantastic team can produce. My faith in humanity was restored! I never slept so well that the following night. Thank you Geoffrey Miller Solicitors!
Testimonial for Geoffrey Miller Solicitors – Outstanding Service and Expertise
I cannot thank Geoffrey Miller Solicitors enough for the exceptional service they provided in handling my case. From the very first point of contact with Jeanette Miller, I knew I was in good hands. Jeanette took the time to listen carefully to my situation and offered thoughtful advice before any formal arrangement or payment was made. This initial approach immediately put me at ease and demonstrated the firm’s genuine care and professionalism.
The clarity of the pricing structure was a major positive—everything was laid out from the beginning with complete transparency. There were no hidden fees or surprises, which gave me peace of mind and allowed me to focus on preparing for my case.
Special mention must go to Skye Pattison, who was my main case worker. Skye was absolutely fantastic throughout the entire process. She was always punctual, polite, and approachable, making herself readily available to answer any questions I had over the four weeks leading up to my court date. Her expertise in motor offence cases was evident at every step, and her analytical approach and attention to detail ensured that the best possible mitigation was prepared. Skye’s patience and thoroughness were truly impressive, and she gave me confidence that we were leaving no stone unturned.
On the court day, the advocate appointed to represent me, Mr. Lee Tilling, was equally exceptional. He was professional, to the point, and presented my case with precision and confidence. Thanks to the combined efforts of Skye and Lee, I received a sentence outside of the usual guidelines, which was an excellent outcome and far better than I had anticipated.
I highly recommend Geoffrey Miller Solicitors to anyone in need of expert advice and representation for motor offences. The team’s knowledge, efficiency, and dedication are second to none, and I am extremely grateful for their support and expertise throughout the process.
I had a very positive experience with Geoffrey Miller Solicitors. Especially Elnaz and Gillian. I was going through a very tough time and they were both patient, professional and informative in relation to the matter. But I just wanted to leave a review to say thank you and let others know to consult Geoffrey Miller Solicitors for matters related to drink driving. They really are the best and know exactly how to go about the case to get you the best possible outcome. My case was discontinued before trial. Once again, I thank the whole team for the chance to move on, now only in the right way.
After a serious car accident and being found over the legal limit, I spoke to Jeanette on the phone who gave me a level of assurance and comfort that she and her team could assist. Throughout the process they were very knowledgeable, helpful and understanding. My case was discontinued the day before trial which was an amazing result. I trusted the team and the outcome is evidence of their experience, expertise and knowledge. I would highly recommend GM solicitors.
