If you are awaiting your driving licence renewal and have sent off your application to DVLA but have not had a response from them, to continue driving legally under Section 88, you must meet all of the following criteria:

Has your doctor told you that you are fit to drive?(Required)

Your doctor must have told you that you are fit to drive. If your doctor is unsure about how a medical condition affects driving, they should refer to the ‘Assessing fitness to drive – a guide for medical professionals'.

If you have a medical condition requiring further information or examination, has your doctor told you that you are unfit to drive?(Required)

If you are currently applying to renew your driving licence and have a medical condition, the guidance issued on 8/02/2021 states that providing you have a current driving licence and you have not been told by your doctor or optician that you should not drive, you will be able to drive while DVLA is considering your application and waiting for a response from NHS professionals. You must still meet the other criteria under Section 88 of the Road Traffic Act 1988.
