NEW DRIVERS OFFENCE
If you are a new driver and passed your driving test less than two years before the offence you are faced with now, you need to take your next steps very carefully. If a driver amasses as many as six points on his licence within the first two years of passing his driving test, he faces immediate revocation of his licence.
This two-year period is known as the ‘probationary period’ and applies from when the new driver passes his or her test (not when he or she receives the actual licence, which can be later). It only applies to new drivers who pass their first test on or after 1 June 1997.
If a new driver receives penalty points that take him to six or more penalty points within the ‘probationary period’, the magistrates have no alternative but to order that his licence should be revoked.
A new driver cannot present ‘exceptional hardship’ arguments as the decision to revoke his licence has nothing to do with the court but rests in the hands of the DVLA and, ultimately, the Secretary of State. You are entitled to appeal against the conviction that led to revocation but you cannot appeal against the revocation itself. If you decide to appeal against conviction, it is possible for your licence to be restored pending appeal.
