Victory in the High Court: A Landmark Win for Procedural Fairness in Drug Driving Prosecutions

On 9 October 2025, Geoffrey Miller Solicitors secured a decisive High Court victory in R (Bimbrah) v Reading Magistrates’ Court, challenging the legality of a trial adjournment in a drug driving case. This judgment reinforces the principle that justice must be timely and procedurally fair.

Background to the Case

Mr Bimbrah faced allegations of driving over the legal limit for THC, the psychoactive component of cannabis. The prosecution relied on blood analysis by Eurofins Forensic Services, claiming THC levels of 9.8 µg/L—far above the legal limit of 2 µg/L.

However, the prosecution repeatedly failed to comply with court directions:

• Three separate failures to serve the required expert report (SFR2) on time.
• Failure to provide the analytical data pack, essential for the defence to obtain its own expert analysis.
• Failure to ensure the attendance of the prosecution’s expert at trial.

Despite these breaches, Reading Magistrates’ Court granted an adjournment on the day of trial, citing the seriousness of the charge and the interests of justice.

Grounds for Judicial Review

Geoffrey Miller Solicitors argued that the adjournment was:

• Unlawful and irrational, given repeated non-compliance.
• Inadequately reasoned, lacking the rigorous scrutiny required under the Criminal Practice Directions and case law.

Ms Justice Obi agreed, finding that the magistrates had failed to apply the correct legal test and had overlooked key factors:

Outcome and Remedy

The High Court quashed the adjournment decision and ordered the case to be remitted with a direction to acquit.
