The Biggest Myths in Drink and Drug Driving Defence

At Geoffrey Miller Solicitors, we regularly encounter prospective clients who’ve been misled by exaggerated claims from so-called motoring law “experts.” These myths not only distort expectations but can also lead to poor decisions and wasted money. Let’s break down some of the most common misconceptions….and how to spot the cowboys.

Myth 1: “Your case will be dropped before you even enter a plea.”

This is one of the most misleading promises we hear, and we hear it all the time!

While it’s technically possible for a case to be discontinued early, it’s extremely rare. Most drink and drug driving cases involve complex factual and technical arguments, often requiring interpretation of the law. Prosecutors are unlikely to agree with a defence interpretation without a fight.

Why it’s unlikely:

• Legal complexity: Even strong defences often hinge on nuanced legal arguments.
• System inefficiency: The criminal justice system is under immense strain. Prosecutors are overwhelmed and rarely have time to review pre-plea representations unless the issue is glaring and irrefutable.

We’ve had exceptions; cases with blatant procedural errors or irremediable flaws but even then, it often takes persistence, multiple hearings, and sometimes a trial to get the case dropped.

What’s really happening:

• Some firms use the promise of a getting a case dropped early to secure upfront fees.
• Once you’ve paid, you’re often stuck or you end up paying twice if you switch firms.

Myth 2: “The MGDD booklet is 25 pages of questions and it’s always mishandled.”

The MGDD (Manual Guidance for Drink and Drug Driving) booklets used by police are important but they are not the labyrinth some firms make them out to be. The forms are designed to streamline the process, and many questions are skipped depending on the suspect’s answers to questions.

Form MGDD/A used in all breath drink driving cases has 25 pages and many questions but if you take a closer look at the questions, many of them are likely to be skipped. For example, question A6 suggests skipping to A26 (missing out 20 questions!) if the case involves a railway or tram offence.

Other questions do not have to be recited to the suspect and are for police guidance.

The lawyer who sells their services on the basis of “ the police should have asked you questions from a 25 page booklet” is not being completely transparent and we advise to proceed with extreme caution if this is the lawyer you choose to appoint.

Reality check:

• It’s not 25 pages of interrogation. Many sections are conditional and skipped.
• Misrepresenting its complexity is a tactic used to make clients think their case is more flawed than it is.
• We use the MGDD booklet as part of a broader defence strategy, but we don’t pretend it’s a silver bullet.

Myth 3: “It is best to have the same solicitor handing the preparation of your case and attending court.”

One of the most overlooked aspects of successful drink and drug driving defence is the division of responsibilities between case preparation and court advocacy. It’s rare for solicitor advocates to possess both the efficiency and the skill set required to manage a case proactively and reactively behind the scenes and deliver the arguments successfully in court.

How to Spot the Cowboys

If you’re unsure who to trust, here are some practical steps:

1. Check independent review platforms Look for genuine reviews on platforms like Trustpilot or Google. Be wary of firms that only show curated testimonials or use review platforms that can be manipulated so negative reviews are not displayed.
2. Look at the negative reviews Every firm gets a few, but patterns matter. Are they recent? Do they mention misleading advice or poor communication?
3. Check the content of reviews  For the firms that claim to have cases dropped in the early stages, where is their data to support this? Where are the reviews? If none of their reviews mention cases being withdrawn prior to a plea being entered this should be a BIG RED FLAG!
4. Watch for misleading marketing Some firms claim “1000+ Trustpilot reviews” but hide the fact that only one is actually on Trustpilot. Always read the small print.
