1. New Warning: Forensic Science Regulator’s Notification 02‑2025

On 17 July 2025, the Forensic Science Regulator (FSR) issued Notification 02‑2025, alerting the Criminal Justice System to significant risks in using rapid drug‑testing kits under the now outdated Home Office Circular 015/2012 GOV.UK+1GOV.UK+1.

Key concerns raised include:

  1. A more complex drug market. Mixtures, novel psychoactive substances (e.g. nitazenes), and varying purities, that existing kits may fail to detect accurately.
  2. Lack of centralised training and competency frameworks, leading to misinterpretation of results.
  3. No consistent quality assurance across approved kits, nor assurance mechanisms for new or unapproved devices.
  4. Evidence of “scope creep” beyond the Circular’s original intent, increasing risk in Criminal Justice System reliance GOV.UK.

This circular underscores that without proper accreditation, training, or updated regulation, rapid test results lack the forensic reliability needed to prove guilt beyond reasonable doubt.

2.The Randox Toxicology Scandal

The Randox Testing Services scandal remains a stark example of forensic failure. Investigations found that between 2014 and 2017, results from forensic toxicology testing, including drug‑driving evidence, were allegedly manipulated. Over 10,000 cases, including criminal convictions, were re‑examined after the scandal emerged The Guardian+5Wikipedia+5The Independent+5.

The Regulator’s Notification 07‑2024, published in December 2024, confirmed that Greater Manchester Police would take no further criminal action against the seven individuals investigated, citing overwhelming material and insufficient resources but it reaffirmed that the data integrity issue affected forensic toxicology services at both Randox and Trimega Laboratories Wikipedia+2GOV.UK+2Randox Testing Services+2.

This crisis was described by senior forensic leads as “the most serious breach of forensic science standards in living memory,” leading to thousands of convictions being overturned, including for driving and violent offences GOV.UK+5The Week+5Wikipedia+5. Personal impacts are severe: one individual, Luke Pearson, lost a year of driving license, employment, financial stability, and well‑being, despite eventual exoneration thejusticegap.com.

We were involved in several cases back then where we raised the alarm about suspicions of not only unreliable forensic analysis but deliberately misleading practices. Thankfully, we did not have any clients wrongfully convicted in the first place as our Not Guilty achievements for the vast majority of clients meant we avoided wrongful convictions.

3.Why This Matters for a Not Guilty Defence

In criminal proceedings, forensic results are often pivotal. But:

  1. Rapid test kits are screening tools, not definitive analysis. Questions about kit quality, operator training, or appropriate interpretation can create reasonable doubt.
  2. Manipulation or systemic failures as in the Randox scandal, demonstrate how toxicology evidence can be compromised, undermining trust in lab reports.
  3. Defence cases can spotlight issues such as chain‑of‑custody, accreditation gaps, competence of personnel, and unknown or disallowed updates in testing procedures.

Where forensic reliability is challenged, the Crown’s case can and often does collapse when we are involved, or at minimum, serious doubt can be raised to support acquittal.
