Minimising Court Attendance

At Geoffrey Miller Solicitors, we understand that attending court can be stressful, time-consuming, and costly. For many clients facing motoring charges, the thought of appearing in court can bring significant anxiety. That is why we developed our Staged Package Process – a unique, results-focused service designed to help clients resolve their cases efficiently and, where possible, without having to attend court.

This approach has been successfully used in numerous cases where we make strategic written representations to the court in the early stages. Where this strategy succeeds, the court can impose penalties based on the paperwork alone. This outcome allows our clients to avoid court entirely and significantly reduces legal costs and emotional stress.

When Is the Staged Package Suitable?

Our Staged Package is designed for clients:

  1. Who are considering or intending to plead guilty.
  2. Whose cases are likely to be dealt with by the Single Justice Procedure or by written representations.
  3. Who are not facing charges where court attendance is mandatory, such as drink driving, drug driving, or failing to provide a specimen.
  4. Who are not at risk of a mandatory disqualification due to already having 12 or more points on their licence (also known as a totting up disqualification).

If your case involves any of these circumstances, we can still assist you, but the Staged Package will not be the appropriate service, and we would recommend one of our full court representation packages instead.

We offer four levels of representation – Silver, Gold, Premium, and Elite – designed to suit different circumstances and preferences. All packages provide the same high standard of legal service. The difference lies in the level of seniority of the case handler working on the matter. Where lower-cost options are chosen, a junior team member handles the day-to-day work under direct supervision from a senior manager.

We guarantee no hidden extras. Each stage and level of service is clearly explained in advance.

Stage 1: Single Justice Procedure Notice (SJPN)

If you are pleading guilty and the case is being dealt with under the SJPN process, our initial strategy is to persuade the court to conclude the case on paper. This includes:

  1. An untimed consultation (via phone, Teams, or in person) to gather a detailed mitigation statement and answer all your questions.
  2. Support in completing the SJPN with carefully worded mitigation and concise supporting documentation.
  3. Guidance on preparing up to two character references.
  4. All necessary liaison with the DVLA, Police, Crown Prosecution Service, or court as required.
  5. Full access to your dedicated case handler with motoring law expertise.
  6. Outcome updates, including advice on fines or next steps, if the court chooses not to deal with the case on paper.

If this strategy is successful, the matter concludes at this stage, and no court attendance will be necessary.

Stage 2: If a Hearing Becomes Necessary

If the court declines to deal with the case under Stage 1, we move to Stage 2 which includes:

  1. Drafting and agreeing full mitigation in preparation for a hearing.
  2. Guidance and support in obtaining additional character references.
  3. Help gathering further mitigation materials, such as travel maps, photographs, and diary entries.
  4. Continued support from your case handler with expertise in motoring law.
  5. Detailed guidance to ensure you feel fully prepared for court.

Court Representation

Minimising Court Attendance

Where a hearing is required, we will arrange for one of our expert motoring law barristers or solicitors to represent you. This includes:

  1. A face-to-face pre-hearing conference on the day of court.
  2. Full representation at the hearing, with your advocate presenting your case and mitigation to the court.
  3. Expert guidance and reassurance throughout the hearing to ensure the process is as smooth and stress-free as possible.

Post-Hearing Support

Our commitment to your case does not end in court. After the hearing, we will continue to assist by:

  1. Advising you on penalties imposed, including the start and end dates of any disqualification.
  2. Supporting you with fine payments, court orders, and driving licence administration.
