I am yet to come across a client who intended to drink drive. Virtually every client I speak to starts the conversation with a sense of embarrassment and despite the fact that my team and I do not stand in judgement of anyone who wants our help, there is usually an explanation with an emphatic statement about how they are against drink driving.

The most recent data available shows that 10% of motorists stopped by police failed the roadside screening test.

So why do so many seem to fall foul of the law? We see some common features for a client to be stopped by police in the drink driving cases we are involved in:

1. Nice Car Syndrome

nice-carIf you drive a high performance car or have tinted windows, or other modifications on your car, in our opinion you are far more likely to be targeted by police. Whether this is because the police want the chance of driving your car (something they usually have to do after a drink drive arrest) or they think you may be some kind of celebrity, they must have grounds for asking you to comply with a breath test. These are limited to specific circumstances so best check with the experts to see if you were lawfully stopped in the first place.

2. You are at your lowest ebb

lowest-ebSome say that there is an invisible energy around us that reflects our mood and what’s going on with us. I think there is definitely something to this. Most of us know immediately when something is wrong with a loved one without them even saying a word!

Lots of our clients have been through all manner of personal or professional challenges literally days or hours before being arrested. Maybe this negative energy somehow transmits to the police, “come and get me?”

Next time you are in the midst of a spat with your other half, just make sure that neither of you have any car keys in the vicinity. Even if you go to cool off in your car, you could face prosecution for being drunk in charge. This carries a lower minimum penalty than drink driving (10 penalty points) but is still classed as a criminal conviction.

4. You are drunk

you-are-drunkAlcohol clouds our judgment and we make very foolish decisions after having a few too many. However, there is a huge difference between “sexting your ex” and getting behind the wheel of a car whilst over the limit. You can somehow overcome embarrassment and shame. You are unlikely to feel the same way if you take another’s life.

5. You missed the train or can’t get a cab
