The mobile phone offence was introduced in 2003 and initially required proof that a motorist was using a hand-held device for ‘interactive communication’.

However, gone are the days of being able to split hairs over what is tantamount to using a mobile phone whilst driving. When the mobile phone offence was first introduced, there were a number of notable cases argued by motorists that merely holding a mobile phone should not be considered an offence. There were analogies drawn between holding a mobile phone and holding a banana! Famously, comedian Jimmy Carr, successfully defended a charge by claiming his use of his phone as a voice recorder to record jokes as they popped into his head was not an “interactive communication.”

Early on, there were humorous yet serious legal arguments, such as equating holding a mobile phone to holding a banana. However, a pivotal 2019 High Court case involving a driver named Mr. Bareto, who filmed an accident while driving, led to significant changes. Following a government consultation where 80% supported the change, the law was amended.

Since March 25, 2022, the mere act of holding a mobile device while driving constitutes an offence, regardless of the purpose. This includes but is not limited to:

• Illuminating the screen
• Checking the time or notifications
• Making or receiving calls
• Accessing apps or the internet
• Using the camera or any other function

You are guilty of an offence if you hold and use a phone, sat nav, tablet, or any similar device while driving or riding a motorcycle—no matter the usage intent. This applies even when you are stopped at traffic lights, in traffic queues, or supervising a learner driver.

Using a mobile phone while driving is handled exclusively in the Magistrates’ Court and can lead to a fine of up to £1,000 and six points on your licence. New drivers face particularly stringent consequences, with the potential for immediate licence revocation and a requirement to retake your driving test.

Using a device in hands-free mode is legal, provided you do not hold it at any point. This includes Bluetooth operations and using your phone as a navigation aid. However, the legal landscape can be tricky—for instance, using your phone to pay at a drive-through is allowed, yet scrolling through a music playlist is not.

If involved in an accident, one of the first things the police are likely to check if whether a phone was in used. Even if using a phone lawfully, it could be argued that being on the phone was a distraction that is tantamount to careless or dangerous driving.

It is permissible to use a mobile device during emergencies where stopping is unsafe or impractical in order to call emergency services.
