In a significant turn of events, Section 193 of the Police Sentencing and Courts Acts of 2022, implemented on 28 October 2023, has contributed to the ongoing shift in the approach to crime from punitive measures to a more rehabilitative standpoint. This follows a trend initiated in the 20th century and continued into the 21st century through amendments in 2014 and 2019, all aimed at providing individuals with a more equitable chance at redemption.
Custodial Sentences
A notable aspect of these changes lies in the simplification of rehabilitation periods for custodial sentences. Previously intricate, the periods were categorized based on the duration of custody—up to 6 months, up to 30 months, up to 4 years, and four years plus. Now, the system is streamlined into three clear options: up to and including 1 year, over a year up to and including 4 years, and more than four years. The subsequent table outlines these rehabilitation periods for both adults and those under 18.

The most impactful modification pertains to adult custodial sentences exceeding four years. Previously never considered spent, they will now be deemed spent seven years from the sentence’s completion, along with any associated license period. It’s crucial to note that specified offences will persist on a Disclosure and Barring Service (DBS) check, with the list accessible here.
Reduction in Short-Term Sentencing Periods
Another noteworthy change involves a reduction in rehabilitation periods for individuals sentenced up to a year. In the past, sentences of 0-6 months were spent after two years, and 6-12 month sentences were spent after four years. Now, all prison sentences up to and including a year will be spent a year after the sentence concludes, along with any relevant license period.
Community Orders
Shifting focus to community orders, the process has become more efficient. Instead of waiting a year after completion, these orders are now considered spent as soon as the required tasks, such as unpaid work, are fulfilled.
The Motoring Catch
Unfortunately, these positive adjustments do not extend to motoring offences. The rehabilitation period for motoring endorsements remains fixed at five years. This nuance holds relevance for insurance renewal decisions, as insurers enquire about any convictions within the past five years, factoring in unspent motoring convictions when determining renewal costs.
