Common Bail Conditions
If you are given bail, you might have to agree to conditions like:
- living at a particular address
- not contacting certain people
- giving your passport to the police so you cannot leave the UK
- reporting to a police station at agreed times, for example once a week
If you do not stick to these conditions you can be arrested again and be remanded in custody to wait for your court hearing.
Varying Police Bail Conditions – The Process
There are two steps to vary the conditions imposed by a custody officer:
- Written application to the custody officer requesting a variation in the bail conditions.
- A formal application to the Magistrates’ Court
If the first step is unsuccessful, a formal application can be made to the Magistrates’ Court. This will allow for a hearing to be listed for oral submissions to be made.
Case Study – Successful Application
In April 2020, we successfully persuaded the Court to vary our client’s bail conditions which had limited her ability to be alone with a child under the age of 16, or drive with a child under the age of 18 in her vehicle.
The COVID-19 pandemic meant that her ex-partner, a key worker for the NHS, was unable to continue with the primary care of our client’s children. Her parents and family were unable to assist due to self-isolation after fitting the high-risk criteria.
The court heard our application via a Skype hearing and after our expert representation the conditions were lifted to allow our client to look after her young family unsupervised.
