Mr Duke faced a charge of driving with excess alcohol in Swindon having provided a breath reading just over the legal limit. Mr Duke contacted our firm for legal advice and decided to plead not guilty as the impact of a mandatory drink driving disqualification would have had a serious impact upon his ability to run his business. The firm identified a number of issues concerning the reliability of the breath testing device and with the drink driving procedure carried out at the police station. At trial, the Barrister excluded the evidence of the prosecution expert and the Crown then conceded they had no evidence to offer. Mr Duke was acquitted of the drink driving charge as a result.
