Traffic and road sign violations

Failing to comply with the indication given by a traffic sign is an offence under section 36 of the Road Traffic Act 1988

The following is a none exhaustive list of some of the signs that are covered by this offence:

  • No entry
  • Double white lines
  • Stop at a major road ahead
  • Give way at a major road ahead
  • No 'U' turn
  • Mini roundabout sign
  • Arrow indicating direction to be followed

Failure to comply with any road traffic sign can result in a fine of up to £1000. However, a driver can be disqualified from driving or receive penalty points if they fail to comply with the following signs:

  • Stop
  • Traffic lights
  • No entry signs
  • Double white lines

Fortunately, there are exceptions and to succeed in any prosecution the prosecution must establish that the road signs were lawful.

Punishment

A fine of up to £1000 and, in some cases, discretionary disqualification or 3 penalty points (see above).
