Penalties
The Road Safety Act 2006 has a number of new penalties and changes in penalties planned with no date, as yet, for these to be implemented. The most relevant intended change is the increase in the penalty points for s.172 Fail to Furnish from 3 to 6 points. We suspect this is due to drivers alleged to have been travelling at high speeds choosing to use the current law to their advantage and simply failing to provide driver details where they would face 3 points n conviction as opposed to 6 points or a ban for a high level speeding offence.
We have listed the intended changes that will be implemented under the Act and will update the site with more accurate information once this is known. In the meantime, it is clear that none of the intended changes will be retrospective.
Increased penalties are proposed for the following offences:
- Careless and inconsiderate driving,
- Using a vehicle in a dangerous condition,
- Furious driving and
- Breach of duty to give information as to identity of driver
These proposals have not yet taken effect and as such are not in force.
There are 5 levels of fines applicable to offences tried in the Magistrates’ Court:
