Dr H- Macclesfield- Managing Director
This client faced an allegation of failing to furnish information brought against the company which he managed. The case was at Carlisle Magistrates.
After we attended a case management hearing at court and outlining the issues, the court asked the prosecution (CPS) to consider discontinuing the matter.
The prosecution did not discontinue despite the Court’s suggestion and instead went to great lengths to fill the gaps in their case. We addressed the attempts of the CPS and responded, further narrowing down the real issues.
The trial was listed for 7 December 2006 and the CPS discontinued their case 2 weeks before trial.
Scott Lester – IT Technical Support Analyst – Cheshire
This client was prosecuted for speeding and failing to furnish driver details in Greater Manchester. His case was won at trial and he was acquitted as a result of technical defences being accepted by the Magistrates. An order was made for Mr Lester’s costs to be paid from Court Central Funds.
MI – Property Developer – Cheshire
This client was prosecuted for the offence of failing to furnish information and the case was heard at Wrexham Magistrates’ Court.
The trial was listed for 10 th January 2007 and was discontinued 4 weeks before trial as a result of the Prosecution realising that there was insufficient evidence to provide a realistic prospect of conviction.
An order was made for MI’s costs to be paid from Central Funds. After assessing our client’s bill, the court agreed to pay 66% of the bill submitted to them.
